Terms and Conditions of Dinky Days Photography
1. INTRODUCTION
These Terms and Conditions (“Terms”) govern your use of Dinky Days Photography services and website. By booking our services or using our website, you agree to be bound by these Terms.

2. SERVICES OFFERED
Photography Services:
- Cake smash photography sessions
- Family portrait sessions
- Newborn photography sessions
- Children’s portrait sessions
- Maternity photography sessions
- Christmas Mini Sessions
What’s Included:
Services include only what is specifically listed in your chosen package. Additional services may be offered at photographer’s discretion as complimentary add-ons but are not guaranteed.
What’s Not Included:
Unless specifically stated in your package:
- Extended family group photographs
- Individual portraits of family members
- Additional outfit changes beyond package allowance
- Rush delivery of images
- Physical prints (unless included in package)
3. BOOKING AND PAYMENT
Booking Process:
- Initial inquiry and consultation
- Service agreement must be signed
- Full session fee payment required to secure date
- Session confirmation sent
Payment Terms:
- Session Fee: Due in full at time of booking
- Product Orders: Due at viewing session
- Accepted Payment Methods: Bank transfer, cash
- Currency: All prices in British Pounds (GBP)
Late Payments:
- 10% surcharge applies to payments received after agreed deadline
- No images or products released until full payment received
4. CANCELLATIONS AND RESCHEDULING
Client Cancellations:
- More than 7 days notice: Session fee non-refundable but may be transferred to new date
- Less than 7 days notice: 50% session fee retained
- Less than 24 hours notice: Full session fee forfeited
Rescheduling:
- One reschedule permitted for extenuating circumstances only
- Additional reschedules subject to £50 fee
- Sessions must be completed within 2 months of original date
Photographer Cancellations:
- Full refund or reschedule at client’s preference
- Not liable for circumstances beyond our control
5. SESSION EXPECTATIONS
Client Responsibilities:
- Arrive punctually and appropriately dressed
- Ensure children are well-rested and fed
- Bring required props or outfits
- Cooperate during the session
- Inform us of any special requirements
Session Conduct:
- Sessions last as per package duration
- Additional time charged at £50 per 30 minutes
- Photographer has creative control over lighting and composition
- We cannot guarantee cooperation from subjects
6. TECHNICAL ISSUES
Digital File Management:
- Digital files may occasionally become corrupted due to technical issues beyond our control
- This is an inherent risk of digital photography
- Multiple backup systems used but 100% protection cannot be guaranteed
- Complimentary reshoot offered where possible for technical failures
Data Protection:
- Client data processed in accordance with UK GDPR
- Images stored securely with appropriate access controls
- Raw files deleted after 90 days
- Edited images retained for 12 months
7. IMAGE DELIVERY AND SELECTION
Viewing Process:
- In-person viewing sessions only
- Must be scheduled within 2 weeks of photography session
- Image selection and orders completed at viewing
- Payment required before image release
- Extension Fee: £49 applies if gallery viewing is requested beyond the originally agreed date
Digital Delivery:
- Download links provided within 5 working days of payment
- Links expire after 30 days
- Reactivation fee applies for expired links
Timelines:
- All orders must be finalized within 1 month of session date
- Incomplete orders after 1 month considered abandoned
- No refunds for abandoned orders
8. COPYRIGHT AND USAGE
Photographer Rights:
- Dinky Days Photography retains full copyright of all images
- Right to use images for portfolio, marketing, and promotional purposes
- Client receives personal use license only
Client Rights:
- Personal printing and sharing rights granted
- May share on social media with photographer credit
- Commercial use prohibited without written permission
Model Release:
- Clients grant permission for promotional use of images
- Opt-out available at time of booking
- Changes to usage permission after session may incur charges
9. WEBSITE TERMS
Website Usage:
- For informational purposes only
- Prices and availability subject to change
- We reserve the right to modify website content
Intellectual Property:
- All website content, images, and branding are copyrighted
- Unauthorized use prohibited
- Client testimonials and images used with permission
Privacy Policy:
- Separate privacy policy governs data collection and use
- Available on our website
- Updated periodically
10. LIABILITY AND LIMITATIONS
Limitation of Liability:
- Our liability limited to amount paid for services
- Not responsible for circumstances beyond reasonable control
- Not liable for missed opportunities due to technical issues
- Insurance maintained for professional indemnity
Force Majeure:
- Not liable for delays or cancellations due to:
- Severe weather conditions
- Illness or family emergencies
- Government restrictions
- Equipment failure beyond our control
Client Responsibility:
- Clients responsible for any damage to studio property
- Parents/guardians responsible for children’s behavior and safety
- We are not babysitters or childcare providers
11. COMPLAINTS AND DISPUTES
Complaint Process:
- Concerns must be raised within 14 days of service completion
- Initial contact via email preferred
- Good faith effort to resolve informally
- Written response provided within 7 working days
Quality Standards:
- Images delivered to professional industry standards
- Personal preference differences do not constitute service failure
- Resolution limited to reshoot or partial refund at our discretion
Dispute Resolution:
- UK law governs all agreements
- Disputes resolved through mediation where possible
- Legal action venue: England and Wales courts
12. HEALTH AND SAFETY
Studio Safety:
- Public liability insurance maintained
- Studio risk assessments conducted regularly
- Safety guidelines provided to all clients
- First aid facilities available
COVID-19 Considerations:
- Health and safety protocols followed as per government guidelines
- Clients required to inform us of any symptoms or exposure
- Sessions may be rescheduled for health and safety reasons
13. GENERAL PROVISIONS
Entire Agreement:
- These Terms, service contracts, and privacy policy constitute entire agreement
- Supersedes all previous communications
- Changes must be in writing
Severability:
- If any provision is unenforceable, remainder remains in effect
- Invalid clauses replaced with nearest legal equivalent
Updates:
